Terms & Conditions of Hire

These Terms and Conditions apply to all bookings for the hire and operation of giant inflatable snow globes and associated equipment and services supplied by Giant Snow Globe.

Introduction

The person, company or organisation making the booking is referred to in these Terms and Conditions as the Client. By making a booking and paying the required deposit, the Client confirms that they have read, understood and accepted these Terms and Conditions.

1. The Company

GlobeHire is a trading name of Spotted Frog Entertainment. In these Terms and Conditions, "the Company", "GlobeHire" and "Giant Snow Globe" mean Spotted Frog Entertainment trading as GlobeHire.

All quotations, invoices, contracts of hire and payments are issued by and made to Spotted Frog Entertainment.

2. Booking and Deposit

A 50% non-refundable deposit is required to secure a booking. The deposit is payable upon presentation of the deposit invoice.

No booking, date or resource is held, confirmed or contractually binding until the deposit invoice has been paid in full and cleared funds have been received by the Company. Dates remain provisional and available to other clients until that point.

A booking will not be considered confirmed and no contract shall exist between Giant Snow Globe and the Client until the Company has received the deposit in full and accepted the booking in writing.

The remaining 50% balance must be paid no later than 14 days before the event.

Where a booking is made within 14 days of the event date, the full booking fee may be required at the time of booking and remains payable upon presentation of the invoice.

Payment details and accepted payment methods will be provided on the relevant invoice.

Any alteration to these Terms and Conditions or to the agreed booking must be confirmed in writing by Giant Snow Globe.

3. Event Times and Additional Hours

The agreed hire and operating times will be stated on the Client's booking confirmation.

Unless otherwise agreed in writing, a standard Giant Snow Globe operating booking is for a maximum of four hours, excluding reasonable installation and dismantling time.

The Company requires sufficient access to the venue before the agreed operating time to safely unload, install, inflate, anchor, inspect and prepare the Giant Snow Globe.

If the Client requests that the Giant Snow Globe continues operating beyond the agreed finish time, any extension will be subject to staff availability, venue restrictions and safe operating conditions.

Additional operating time may be charged at the Company's applicable hourly rate and invoiced retrospectively.

If an event starts late for reasons outside the Company's control, the original agreed finish time will normally continue to apply unless otherwise agreed.

4. Cancellation by the Client

All cancellations must be made in writing.

The following cancellation charges apply:

  • More than 28 days before the event: The 50% deposit remains non-refundable.
  • Between 28 and 15 days before the event: 75% of the total agreed booking fee will be payable, consisting of the 50% non-refundable deposit plus 25% of the outstanding balance.
  • Within 14 days of the event: 100% of the total agreed booking fee will be payable.

Where the Client requests a change of event date, Giant Snow Globe will make reasonable efforts to accommodate the request. Any transfer of payments to a new date is at the Company's discretion and subject to availability and any additional costs incurred.

5. Cancellation or Changes by Giant Snow Globe

Giant Snow Globe will make reasonable efforts to fulfil every confirmed booking.

However, the Company reserves the right to alter, suspend or cancel the operation where it reasonably considers this necessary because of safety concerns, adverse weather, equipment failure, venue restrictions or circumstances outside the Company's reasonable control.

The Company shall not be liable for consequential losses arising from cancellation, suspension or alteration caused by circumstances outside its reasonable control.

Such circumstances may include, but are not limited to, extreme weather, high winds, flooding, fire, transport disruption, road closures, industrial action, acts of terrorism, war, civil disturbance, government restrictions, epidemics, pandemics, quarantine or other events beyond the Company's reasonable control.

Where appropriate, the Company will make reasonable efforts to offer an alternative arrangement or date, but this cannot be guaranteed.

6. Weather Conditions

The Giant Snow Globe is an inflatable attraction and its safe operation is dependent upon suitable weather and environmental conditions.

The Company strongly recommends that Clients organising outdoor events consider obtaining appropriate event cancellation and/or adverse weather insurance.

Giant Snow Globe may attend an event during poor weather where it is reasonable and safe to do so. However, the equipment will only be installed or operated when the Company's trained staff consider conditions suitable.

Operation may be delayed, suspended or stopped because of:

  • high or gusting winds;
  • thunderstorms or lightning;
  • heavy rain, flooding or waterlogging;
  • snow or ice affecting safe access or anchoring;
  • unsafe ground conditions;
  • extreme temperatures; or
  • any other weather or environmental condition which the Company considers may affect the safe installation or operation of the equipment.

The Company's staff will monitor conditions and will have final authority as to whether the Giant Snow Globe can safely operate, be suspended or restart.

The Giant Snow Globe will not be operated where wind conditions exceed the safe operating limits applicable to the particular inflatable, its manufacturer's instructions, applicable risk assessment or relevant safety guidance.

No member of the Client's staff, venue staff or public may instruct the Company's operator to continue or restart operation where the operator considers conditions unsafe.

Refunds will not normally be provided where operating time is reduced or lost because weather or site conditions make operation unsafe.

7. Site and Venue Requirements

The Client is responsible for ensuring that the proposed operating area is suitable for the Giant Snow Globe.

The Company must be informed in advance whether the attraction is to be installed indoors or outdoors and of the surface on which it will be positioned.

The operating area must:

  • be sufficiently large for the Giant Snow Globe and all necessary safety and operating areas;
  • provide sufficient overhead and surrounding clearance;
  • be reasonably level;
  • be free from sharp objects, debris and other hazards;
  • provide suitable anchoring arrangements;
  • provide safe access for staff and equipment; and
  • comply with any requirements communicated by Giant Snow Globe before the event.

The Client must inform the Company before installation of any known underground services, cables, pipes, drainage systems, irrigation systems or other hazards where ground anchoring may be required.

Where ground stakes cannot be used, suitable alternative anchoring may be required and additional charges may apply.

The Company reserves the right to refuse installation where the site is unsuitable or cannot be made safe.

8. Access and Delivery

The Client must provide adequate vehicle access to the agreed unloading and operating location.

Access must be suitable for the Company's vehicle and, where applicable, trailer, together with sufficient space to manoeuvre, unload and reload safely.

The Client must notify Giant Snow Globe before booking of any access restrictions, including narrow entrances, height or weight restrictions, stairs, lifts, pedestrian-only areas, loading restrictions, parking restrictions, soft ground or significant distances between the unloading point and operating area.

Additional charges may apply where unusual access arrangements require additional staff, equipment or installation time.

If the Company is unable to deliver or install the equipment because access is materially different from that described by the Client, the Client may remain liable for the full booking fee.

Giant Snow Globe will take reasonable precautions when accessing and operating at the venue but accepts no responsibility for unavoidable marking or disturbance of grass or other ground surfaces resulting from reasonable vehicle, equipment or anchoring use, except where caused by the Company's negligence.

9. Electrical Supply

The Giant Snow Globe requires a suitable and reliable electrical supply for inflation and continued operation.

Unless otherwise agreed, the Client is responsible for ensuring that suitable power is available at the agreed operating location.

The Client must not disconnect, switch off, move or interfere with blowers, cables, electrical equipment or other operating equipment.

Where the Client is unable to provide suitable electricity, alternative power arrangements may be available by prior agreement and may incur an additional charge.

10. Installation and Dismantling

The Giant Snow Globe must only be installed, inflated, anchored, operated, deflated and dismantled by Giant Snow Globe staff or persons specifically authorised by the Company.

The Client, participants, venue staff and members of the public must not move, alter, disconnect or interfere with the inflatable, blowers, anchoring system, electrical equipment or safety equipment.

Access to the Giant Snow Globe outside the official supervised operating period is strictly prohibited unless authorised by the Company.

The Client must ensure that the operating area remains available for the Company's staff for a reasonable period after the event to safely deflate, dismantle and remove the equipment.

11. Operation and Supervision

The Giant Snow Globe will be operated in accordance with the Company's operating procedures, risk assessments, manufacturer requirements and applicable safety guidance.

Instructions given by Giant Snow Globe staff must be followed at all times.

The Company's operator has final authority regarding:

  • the number of participants permitted inside the snow globe at any one time;
  • participant suitability;
  • safe entry and exit;
  • weather conditions;
  • operating conditions;
  • suspension or closure of the attraction; and
  • any other matter affecting safe operation.

The Company may temporarily suspend operation where necessary for safety checks, maintenance, cleaning, adjustment, weather monitoring or other operational reasons.

12. Participant Safety

All participants must follow instructions given by Giant Snow Globe staff.

Participants must enter and leave the Giant Snow Globe only through the designated entrance and exit and when instructed to do so.

Running, wrestling, climbing, deliberately falling into the sides, jumping against the inflatable walls or any other reckless behaviour is prohibited.

Participants must not interfere with the inflatable structure, air system, blowers, anchoring equipment, electrical equipment or safety equipment.

Where required by the operator, shoes must be removed before entering the Giant Snow Globe. Sharp objects or items which may damage the inflatable must not be taken inside. This may include keys, sharp jewellery, glass, food, drinks, cigarettes, vaping equipment or other items identified by the operator.

Food, drinks, chewing gum, smoking and vaping are prohibited inside the Giant Snow Globe.

The Company reserves the right to impose reasonable restrictions relating to participant numbers, age, height, mobility or other factors where necessary for safe operation.

13. Children and Vulnerable Participants

Where children participate, the Client remains responsible for ensuring that appropriate parental or guardian consent and event supervision arrangements are in place.

Giant Snow Globe staff are responsible for operating the attraction safely but are not responsible for general childcare, supervision of children elsewhere at the event, recording attendance or ensuring that children are collected by an appropriate adult.

Children must comply with the operator's instructions at all times.

Where a participant requires additional assistance, the Client should inform Giant Snow Globe in advance so that reasonable arrangements can be considered.

14. Health and Medical Conditions

Participants should not enter the Giant Snow Globe if they have a medical condition, injury or other circumstance that would make participation unsafe.

Participants who are pregnant, have significant mobility difficulties, heart conditions, serious respiratory conditions, recent injuries or any other relevant medical condition should consider whether participation is appropriate and, where necessary, seek appropriate medical advice.

The Client is responsible for obtaining any medical information, parental permissions or consents required for its event.

Participants must inform the operator of any relevant circumstances that may affect their ability to safely participate.

15. Alcohol, Drugs and Unsafe Behaviour

Giant Snow Globe reserves the right to refuse entry to or remove any person who appears to be intoxicated, under the influence of drugs, aggressive, abusive or otherwise behaving in a way that may endanger themselves, other participants, staff or equipment.

No refund will be provided to an individual or Client because a participant has been refused access or removed for safety or behavioural reasons.

16. Staff Safety and Conduct

Giant Snow Globe staff are entitled to work in a safe environment.

Abusive, threatening, discriminatory, intimidating or violent behaviour towards Company staff will not be tolerated.

The Company reserves the right to suspend or terminate operation immediately where staff safety or welfare is at risk.

Where an event is terminated because of the conduct of the Client, its guests, attendees, venue personnel or members of the public, no refund will be payable.

17. Damage to Equipment

The Client must take reasonable steps to prevent deliberate or negligent damage to the Company's equipment.

Unauthorised interference with the Giant Snow Globe, blowers, electrical systems, anchoring equipment, props or safety equipment is strictly prohibited.

The Client may be charged for damage caused by the Client, its employees, contractors, guests or participants where that damage results from deliberate acts, negligence, misuse or failure to follow the Company's instructions. This may include reasonable repair, replacement, cleaning and associated costs.

The Company reserves the right to take appropriate legal action in cases of deliberate or malicious damage.

18. Personal Belongings

Participants are responsible for their own belongings.

Giant Snow Globe accepts no responsibility for loss, theft or damage to personal possessions brought to or left at the attraction except to the extent that such loss or damage is caused by the negligence of the Company.

Participants should not take valuables or items that could become lost or damaged into the Giant Snow Globe.

19. Photography and Mobile Phone Use

The Giant Snow Globe is designed primarily as an interactive photographic attraction.

Guests are encouraged to take their own photographs using their mobile phones from inside the globe. We do not provide event photography, photo booth equipment, printing or digital image services as standard; where any such service is agreed separately in writing, it will be stated in the booking confirmation.

The Client is responsible for informing attendees that photography may take place and for obtaining any permissions or consents that the Client is legally required to obtain, particularly where children or vulnerable persons are involved.

Giant Snow Globe will not use identifiable photographs of participants for its own marketing or promotional purposes without an appropriate lawful basis and any consent required by applicable data protection law.

Where photographs are supplied digitally, the Company cannot guarantee indefinite storage of the images. Clients should download and securely retain any images they wish to keep within any timeframe communicated by the Company.

20. Client or Third-Party Photographers and Filming

Unless otherwise agreed, Clients and participants may take their own photographs and videos using mobile phones from designated safe areas.

Professional photographers, videographers and other suppliers must not obstruct entrances, exits, blowers, electrical equipment, anchoring systems or operating staff.

Lighting, tripods, cables and other photographic equipment must be positioned so that they do not create a trip hazard or interfere with the safe operation of the Giant Snow Globe.

Any special photographic installation must be agreed with Giant Snow Globe in advance.

21. Liability

Giant Snow Globe will take reasonable care in the installation, operation and supervision of its equipment.

Nothing in these Terms and Conditions excludes or limits any liability which cannot lawfully be excluded or limited, including liability for death or personal injury caused by the Company's negligence.

Subject to applicable law, the Company will not be responsible for loss or damage arising from:

  • a participant's failure to follow safety instructions;
  • misuse or unauthorised interference with equipment;
  • unsafe or reckless participant behaviour;
  • inaccurate information supplied by the Client;
  • unsuitable venue or site conditions not disclosed to the Company;
  • circumstances outside the Company's reasonable control; or
  • loss or damage to personal belongings, except where caused by the Company's negligence.

The Client remains responsible for the organisation and management of the wider event and for matters outside the Company's agreed scope of services.

22. Insurance

Giant Snow Globe will maintain appropriate insurance for its business operations as required.

The Client is responsible for arranging appropriate insurance for the wider event, venue and activities for which the Client is responsible.

For outdoor events, the Company recommends that the Client considers event cancellation and adverse weather insurance.

23. Changes to a Booking

Requests to change the event date, venue, operating hours or other material details must be made in writing.

Giant Snow Globe will make reasonable efforts to accommodate requested changes but cannot guarantee that changes will be possible.

Where a change results in additional travel, staffing, equipment or other costs, the Company reserves the right to revise the booking price.

If a requested change cannot be accommodated, the original booking will remain binding unless otherwise agreed in writing.

24. Delays

Giant Snow Globe will make reasonable efforts to arrive with sufficient time to install the equipment before the agreed operating period.

The Company shall not be responsible for delays caused by circumstances outside its reasonable control, including severe traffic disruption, road closures, accidents, extreme weather or venue access problems.

Where a delay is caused by the Client, venue or another supplier, the Company's agreed finish time will normally remain unchanged and no refund will be payable for lost operating time.

25. Cleaning and Excessive Soiling

Normal cleaning associated with ordinary use is included within the hire.

The Client may be charged reasonable additional cleaning costs where equipment is returned in an excessively dirty condition or contaminated by food, drink, chewing gum, face paint, confetti, silly string, mud or other substances resulting from misuse or failure to follow operating instructions.

Confetti, glitter, silly string and similar materials must not be used inside the Giant Snow Globe unless specifically approved by the Company in advance.

26. Safety Decisions

Safety decisions made by Giant Snow Globe staff are final.

The Client acknowledges that the operator may reduce participant numbers, pause operation, alter procedures or close the attraction where reasonably necessary to maintain safe operation.

No person may pressure or instruct an operator to disregard safety procedures, manufacturer guidance, risk assessments or weather restrictions.

27. Client Responsibilities

The Client is responsible for providing Giant Snow Globe with accurate information concerning the event, including the venue, access, operating surface, expected attendance and any known restrictions or hazards.

The Client must also obtain any permissions required from the venue, landowner or relevant authority for installation and operation of the Giant Snow Globe.

Any permits, licences or venue approvals that are specifically the Client's responsibility must be obtained before the event.

The Client must communicate any relevant restrictions or requirements imposed by the venue to Giant Snow Globe sufficiently in advance.

28. Complaints

Any concerns during the event should be raised with the Giant Snow Globe operator as soon as reasonably possible so that the Company has an opportunity to address them.

Any formal complaint following an event should be submitted to Giant Snow Globe in writing, together with sufficient information to investigate the matter.

The Company will make reasonable efforts to investigate and respond promptly.

29. Data Protection

Personal information supplied in connection with a booking will be handled in accordance with applicable UK data protection legislation.

Information will be used for purposes reasonably connected with administering the booking, providing the contracted services, processing payments, communicating with the Client and meeting the Company's legal and operational obligations.

Further information concerning the Company's processing of personal data should be provided in Giant Snow Globe's Privacy Policy.

30. General

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A failure by Giant Snow Globe to enforce any provision on one occasion shall not constitute a waiver of its right to enforce that provision subsequently.

No variation of these Terms and Conditions shall be binding unless agreed in writing by Giant Snow Globe and the Client.

31. Governing Law

These Terms and Conditions and any contract between Giant Snow Globe and the Client shall be governed by the laws of England and Wales, unless otherwise required by applicable law.

Any dispute arising from the booking shall be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights the Client may have as a consumer.

Booking Acceptance

By paying the required deposit or otherwise confirming the booking, the Client confirms that they have read, understood and agree to these Terms and Conditions.
